1. Acceptance of these terms١. قبول هذه الشروط

By creating an account, accessing or using MILA, you agree to these Terms of Service. If you are using MILA on behalf of an institution (a school, university, training center or business), you confirm that you are authorized to accept these terms for that institution, and "you" then refers to both you and that institution. بإنشائك حسابًا على MILA أو وصولك إليها أو استخدامك لها، فإنك توافق على شروط الخدمة هذه. وإذا كنت تستخدم MILA نيابةً عن مؤسسة (مدرسة أو جامعة أو مركز تدريب أو شركة)، فإنك تقرّ بأنك مخوّل بقبول هذه الشروط باسم تلك المؤسسة، ويشير عندئذٍ مصطلح «أنت» إليك وإلى تلك المؤسسة معًا.

If you do not agree with any part of these terms, please do not use the platform. وإذا كنت لا توافق على أي جزء من هذه الشروط، فيُرجى عدم استخدام المنصّة.

2. Description of the service٢. وصف الخدمة

MILA is a learning management system whose AI explains its reasoning. The platform covers course and content management, assessments with anti-cheat controls, an AI tutor, AI quiz generation, AI essay grading that a teacher approves, learning analytics, an early-warning system that flags at-risk students and explains why, WhatsApp notifications, and an optional parent portal. MILA هي نظام لإدارة التعلّم، ويشرح ذكاؤه الاصطناعي الأسباب وراء نتائجه. تشمل المنصّة إدارة المقررات والمحتوى، والاختبارات بضوابط لمنع الغش، والمساعد الذكي، وتوليد الأسئلة بالذكاء الاصطناعي، وتصحيح المقالات بالذكاء على أن يعتمده المعلّم، وتحليلات التعلّم، ونظام إنذار مبكر ينبّه إلى الطلاب المتعثّرين ويوضّح السبب، وإشعارات WhatsApp، وبوابة اختيارية لوليّ الأمر.

We may add, change or remove features over time to improve the service. Some capabilities depend on the plan your institution chooses or on settings an administrator enables. قد نضيف ميزات أو نعدّلها أو نزيلها بمرور الوقت لتحسين الخدمة. وتعتمد بعض الإمكانات على الخطة التي تختارها مؤسستك أو على إعدادات يفعّلها المسؤول.

3. Accounts & eligibility٣. الحسابات والأهليّة

Accounts are provided to institutions and to the users an institution invites. To use MILA you must: تُقدَّم الحسابات للمؤسسات وللمستخدمين الذين تدعوهم المؤسسة. ولاستخدام MILA يجب عليك:

• Provide accurate registration information and keep it up to date.تقديم معلومات تسجيل دقيقة والحفاظ على تحديثها.
• Keep your login credentials confidential and not share them with others.الحفاظ على سرّية بيانات دخولك وعدم مشاركتها مع الآخرين.
• Be old enough to hold an account under your local law. Where students are minors, they should be enrolled by an institution that manages consent on their behalf.أن تكون قد بلغت السنّ القانونية لامتلاك حساب وفق قانونك المحلي. وحين يكون الطلاب قُصَّرًا، تتولّى مؤسسة تسجيلهم وإدارة الموافقة بالنيابة عنهم.

You are responsible for activity that happens under your account. Tell us promptly if you suspect any unauthorized access. أنت مسؤول عن النشاط الذي يجري ضمن حسابك. وأبلِغنا فورًا إذا اشتبهت في أي وصول غير مصرّح به.

4. User responsibilities & acceptable use٤. مسؤوليات المستخدم والاستخدام المقبول

MILA is here to support honest teaching and learning. When you use the platform, you agree not to: MILA منصّة تدعم التعليم والتعلّم النزيهين. وعند استخدامك لها، فإنك توافق على عدم القيام بما يلي:

• Cheat, or attempt to bypass, disable or circumvent anti-cheat controls, question randomization, timing or session monitoring.الغشّ، أو محاولة تجاوز ضوابط منع الغش أو تعطيلها أو الالتفاف عليها، أو على عشوائية الأسئلة أو التوقيت أو مراقبة الجلسة.
• Submit work that is not your own, or misrepresent AI-generated output as your own original work where that is not permitted.تقديم عمل ليس من إنتاجك، أو تقديم مُخرَجات الذكاء الاصطناعي على أنها عملك الأصلي حيثما لا يُسمح بذلك.
• Provide false, misleading or impersonating information, or access accounts that are not yours.تقديم معلومات كاذبة أو مضلّلة أو منتحلة لهوية الغير، أو الوصول إلى حسابات ليست لك.
• Upload malware, attempt to breach security, scrape data at scale, or overload, disrupt or reverse-engineer the platform.رفع برمجيات خبيثة، أو محاولة اختراق الأمن، أو سحب البيانات بكمّيات كبيرة، أو إثقال المنصّة أو تعطيلها أو إجراء هندسة عكسية عليها.
• Harass, abuse or harm other users, or post unlawful, hateful or infringing content.مضايقة المستخدمين الآخرين أو إساءة معاملتهم أو إيذاءهم، أو نشر محتوى غير قانوني أو يحضّ على الكراهية أو ينتهك الحقوق.

5. Educational content & intellectual property٥. المحتوى التعليمي والملكية الفكرية

You keep what you create. Courses, lessons, videos, documents, question banks, assignments and other materials uploaded by an institution or instructor remain the property of that institution or instructor, who is responsible for having the rights to use and share them. تحتفظ بما تنشئه. تبقى المقررات والدروس ومقاطع الفيديو والمستندات وبنوك الأسئلة والواجبات وسائر المواد التي ترفعها مؤسسة أو مدرّب ملكًا لتلك المؤسسة أو ذلك المدرّب، وهو المسؤول عن امتلاك حقوق استخدامها ومشاركتها.

To run the service, you grant MILA a limited, non-exclusive license to host, store, process, display and deliver your content to the users you authorize. That might mean showing a lesson to enrolled students or generating quiz questions from a document you provide. The license covers only the operation of the platform, and it ends when you remove the content or close the account, except for copies we must keep by law. ولتشغيل الخدمة، فإنك تمنح MILA ترخيصًا محدودًا غير حصري لاستضافة محتواك وتخزينه ومعالجته وعرضه وتسليمه للمستخدمين الذين تصرّح لهم، كعرض درس على الطلاب المسجَّلين أو توليد أسئلة اختبار من مستند تقدّمه. ويقتصر هذا الترخيص على تشغيل المنصّة، وينتهي عند إزالتك للمحتوى أو إغلاق الحساب، باستثناء النسخ التي نحتفظ بها وفقًا لما يقتضيه القانون.

The MILA platform itself belongs to MILA: its software, design, name, logo and other marks. These terms do not transfer any of those rights to you, and you may not copy, resell or rebrand the platform. أمّا منصّة MILA نفسها فهي ملك لـ MILA، بما في ذلك برمجياتها وتصميمها واسمها وشعارها وعلاماتها الأخرى. ولا تنقل هذه الشروط أيًّا من تلك الحقوق إليك، ولا يجوز لك نسخ المنصّة أو إعادة بيعها أو إعادة تسميتها بعلامتك.

6. AI features: responsible use and human oversight٦. ميزات الذكاء الاصطناعي: الاستخدام المسؤول والإشراف البشري

MILA's AI features (the tutor, quiz generation, essay grading and the early-warning system) are built to assist educators, not to replace their judgment. Every AI output comes with a plain explanation a person can read, and a human stays in charge of decisions that matter. The AI suggests, and a teacher or administrator approves the result or changes it. بُنيت ميزات الذكاء الاصطناعي في MILA (المساعد، وتوليد الأسئلة، وتصحيح المقالات، ونظام الإنذار المبكر) لمساعدة المعلّمين لا لاستبدال حُكمهم. ويأتي كل مُخرَج للذكاء مصحوبًا بتفسير واضح يفهمه الإنسان، ويبقى القرار المهم بيد إنسان. فالذكاء يقترح، والمعلّم أو المسؤول يعتمد النتيجة أو يعدّلها.

AI outputs help, but they are not the final word. They can contain mistakes or leave things out, so review them before you rely on them. A suggested grade, a generated question or a risk flag is a recommendation. The institution and its staff hold final responsibility for academic and pastoral decisions. مُخرَجات الذكاء الاصطناعي تساعدك، لكنها ليست الكلمة الأخيرة. فقد تتضمّن أخطاءً أو إغفالات، لذا راجِعها قبل الاعتماد عليها. والدرجة المقترحة أو السؤال المولَّد أو تنبيه الخطر هو توصية. وتبقى المسؤولية النهائية عن القرارات الأكاديمية والتربوية على عاتق المؤسسة وكوادرها.

7. Privacy٧. الخصوصية

Our handling of personal data is described in our Privacy Policy, which forms part of these terms. It explains what we collect, how we protect student and teacher data, how our explainable AI works with human oversight, and the rights you keep. Please read it alongside these terms. يَرِد وصف تعاملنا مع البيانات الشخصية في سياسة الخصوصية الخاصة بنا، وهي جزء من هذه الشروط. وتوضّح ما نجمعه، وكيف نحمي بيانات الطلاب والمعلّمين، وكيف يعمل ذكاؤنا القابل للتفسير بإشراف بشري، والحقوق التي تحتفظ بها. يُرجى قراءتها إلى جانب هذه الشروط.

8. Fees & plans٨. الرسوم والخطط

Some plans are free or offered as a trial, while others are paid. Where fees apply, they are agreed with your institution in a separate order or plan and are based on the features and usage you select. بعض الخطط مجانية أو تُقدَّم على هيئة فترة تجريبية، وبعضها مدفوع. وحيثما تنطبق الرسوم، يُتَّفق عليها مع مؤسستك في طلب أو خطة منفصلة، وتُحدَّد بناءً على الميزات ومستوى الاستخدام الذي تختاره.

• Unless stated otherwise, fees are billed in advance for the agreed period and are non-refundable except where required by law.ما لم يُذكر خلاف ذلك، تُحتسب الرسوم مقدّمًا عن الفترة المتّفق عليها، وهي غير قابلة للاسترداد إلّا حيثما يقتضي القانون ذلك.
• We may update pricing for future periods, with reasonable notice before any renewal.قد نحدّث الأسعار للفترات المستقبلية، مع إشعار معقول قبل أي تجديد.
• You are responsible for any applicable taxes that are not already included in the agreed fees.أنت مسؤول عن أي ضرائب مطبَّقة لم تكن مشمولة أصلًا في الرسوم المتّفق عليها.

9. Disclaimers & limitation of liability٩. إخلاء المسؤولية وحدودها

MILA is provided "as is" and "as available". While we work hard to keep the service reliable, secure and accurate, we do not warrant that it will be uninterrupted, error-free, or that AI outputs will be entirely correct. تُقدَّم MILA «كما هي» و«حسب توافرها». ومع أننا نجتهد للحفاظ على خدمة موثوقة وآمنة ودقيقة، فإننا لا نضمن أنها ستكون دون انقطاع أو خالية من الأخطاء، ولا أن مُخرَجات الذكاء الاصطناعي ستكون صحيحة تمامًا.

To the maximum extent permitted by law, MILA is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill arising from your use of the platform. Nothing in these terms limits liability that cannot be excluded under applicable law. وإلى أقصى حدّ يسمح به القانون، لا تتحمّل MILA المسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية، ولا عن فقدان البيانات أو الأرباح أو السمعة الناشئ عن استخدامك للمنصّة. ولا يحدّ أيٌّ مما ورد في هذه الشروط من مسؤولية لا يمكن استبعادها بموجب القانون المعمول به.

10. Suspension & termination١٠. الإيقاف وإنهاء الخدمة

We may suspend or terminate access to an account when that is necessary to protect users, the platform or the law. For example, when: قد نوقف الوصول إلى حساب أو نُنهيه عندما يكون ذلك لازمًا لحماية المستخدمين أو المنصّة أو القانون، ومن ذلك الحالات التالية:

• These terms or the acceptable-use rules are seriously or repeatedly breached.عند خرق هذه الشروط أو قواعد الاستخدام المقبول خرقًا جسيمًا أو متكرّرًا.
• There is suspected fraud, security risk, or activity that harms other users.عند الاشتباه في احتيال أو خطر أمني أو نشاط يضرّ بالمستخدمين الآخرين.
• Required fees remain unpaid after a reasonable notice, or the law requires it.عند بقاء الرسوم المستحقّة دون سداد بعد إشعار معقول، أو عندما يقتضي القانون ذلك.

Your institution may also end its use of MILA at any time as agreed. On termination, access stops and data is deleted or returned according to the Privacy Policy and any agreement in place. Where practical, we aim to give notice before suspending access. ويجوز لمؤسستك كذلك إنهاء استخدام MILA في أي وقت وفقًا للمتّفق عليه. وعند الإنهاء، يتوقّف الوصول وتُحذف البيانات أو تُعاد وفق سياسة الخصوصية وأي اتفاقية قائمة. وحيثما أمكن، نسعى إلى الإشعار قبل إيقاف الوصول.

11. Changes to the service & these terms١١. تعديلات الخدمة وهذه الشروط

We may update the service and these terms as the platform evolves or the law changes. When we make a meaningful change to the terms, we will update the date above and, where appropriate, notify your institution. Continued use of MILA after an update means you accept the revised terms; if you do not agree, you should stop using the platform. قد نحدّث الخدمة وهذه الشروط مع تطوّر المنصّة أو تغيّر القانون. وعند إجراء تغيير جوهري في الشروط، سنحدّث التاريخ المذكور أعلاه، ونُخطر مؤسستك عند الاقتضاء. ويعني استمرارك في استخدام MILA بعد التحديث قبولك للشروط المُعدَّلة؛ وإن كنت لا توافق، فينبغي التوقّف عن استخدام المنصّة.

12. Governing law١٢. القانون الحاكم

These terms are governed by the laws applicable at the place where your institution and MILA have agreed to do business, without regard to conflict-of-law rules. Where a separate written agreement exists between MILA and your institution, that agreement governs if it conflicts with these terms. تخضع هذه الشروط للقوانين السارية في المكان الذي اتّفقت فيه مؤسستك و MILA على التعامل، دون اعتبار لقواعد تنازع القوانين. وحيثما وُجدت اتفاقية مكتوبة منفصلة بين MILA ومؤسستك، فإن تلك الاتفاقية هي التي تسري عند تعارضها مع هذه الشروط.
